Why would you want to do that? If you live in a right to work state you can legally fire someone for no reason or a good reason but you can't fire them for a bad reasons. So whats your reason?

Most employees can have personal items on their desk. The only thing you could do is make a company policy that no personal items be on ANYONE's desk. You cannot single out an employee or it will be construed as harrassment. Then you'd have to give him several warnings and then you might be able to get away with firing him...

But to fire an employee for having a bible on his desk would probably go against the "Equal Employment Opportunity Act of 1972" as it would be firing him based on his religion. You'd have to ask an attorney to be sure.

If your company operates under the statement "...regardless of race, religion, sexual orientation, etc.," you cannot legally fire the employee based solely on the possession of and public display of a Bible. If it creates bother for other employees, it becomes an HR issue, in which case, you report it to the HR manager. If you don't have one, and you're it, then you need to talk to the person about the issue. Becareful on this because the courts find in favor of the employees not the employers. If any firing is to be done, it has to be based on the person's ability to do the job according to the specified duties for his position. (Creating problem with other employees fits this category also.)

If you are the boss of the company you have the right to fire anyone for anything.

However, firing someone for having a bible on their desk would be a bad idea. That would show a clear religious discrimination. The person you fired can sue... and then be YOUR boss.

No, unless there is a written and distributed company policy against any personal items being allowed on his desk, and you will easily be sued for firing an employee for anything less than gross misconduct, which is described as something that intentionally causes physical harm to himself, another employees or the company.

Doesn't sound like gross misconduct to me.

Well, is he pushing it in others faces? I too dislike "overt" christians who push their beliefs, put even I would draw the line at someone just leaving a Bible on their desk. After all, that's a non-verbal witness and no one has to "take the bait" unless they want to or unless they want to draw out an argument. Perhaps you could say that in order to keep down workplace harrassment of him, and keep people from talking rudely about his religion it would be more appropriate to leave it in his desk unless on break or to take it home. After all, in very few states, like 5, are workers truly protected, sadly.

Call the ACLU and get their opinion without giving your name or place of work.

Are you firing him BECAUSE of the bible? If so, then NO you can't. But if there are other documented reasons for terminating your employee then of course you can.

Why is it that people that don't believe in God get their way on so many issues,such as taking God out of schools, taking down the ten commandments and so on? Why can't they just NOT look at it? No, just ignore it if it bothers you.

you might want to look into the rules and guidlines before you fire this person. You could get sued.
