I am a minor, and I was recently caught under the influence of mushrooms in a public place. I was with two other guys, 'Jake' and 'John'. John was holding whatever small amount of mushrooms we had left(approx. 2 small stems and 1 small cap) in his pocket. However, I had payed for the remainder of the mushrooms that John was holding. John and Jake had already payed for and ate their portion. I was also holding a small nug of pot(appx .5gram). I have had no prior convictions, however three years ago I was expelled from school for pot, but no charges were made. I am not sure if this is on my record or not. We weren't arrested.

My question is what legal reprocussions am I potentialy facing based upon these circumstances? Even though John was holding the mushrooms for me, am I going to be charged with possession because I bought the confiscated amount?

What do you reccomend I do in order to prepare myself for the trial?

Please dont tell me to stop drugs,I just need legal advice.

I'm not saying I have no intention of quitting drugs, I have since quit. I said "Don't tell me to quit drugs" because I knew some self-rightous "concerned citizen" would waste their's and my time by telling me how bad drugs are and why I should quit.. I've heard it before, and its been done. And I can see I was right because five minutes after posting my question someone did just that. This isn't answering my question, and is in no way helpful to me. Thanks :D

My son got 75 hours of community service for pot, first time. In 6 months they will take if off his record. You can probably expect seperate charges for each item if you admitted it was yours.

I guess if you don't care to stop using drugs then I cant see what good preparing to go to trial will do.
Do you have a lawyer. It sounds as if you have no intention of quiting the judge will know because they have heard it all before and they will not care what you say.
Be grateful that it happened in Cali, if you where many other places you could be looking at many years in prison, you could be looking at 8/10 and be out in 4/6 with good behavior

Before the hearing go to an A/A & N/A meetings and get them to sign a paper to show that you are attending the meeting to lesson the charge ask the group leader to show or write a paper on your progress on your behalf.

it will be on your record for life, once you are an adult the record is sealed though never expunged, it can only be accesed for law enforcement reason, but they conviction solely depends on you, you attitude or lack of it will determine how the judge sets sentence, judiging by your lack of remorse for what you do. do expect anything good from the judge.
