You could only take them to small claims court, but it would end up costing you more time than it's worth.
I'm sorry that happened to you.

you should contact your state attorney generals office and the one in california as well and tell them your story, they may be able to help you recover part of your money or at least put pressure on the bbb for you (I have personally found the BBB to be a joke.) Anyhow, you could also contact your local news station and see if they have a rip off report or reporter that can shine light on the situation.

You don't say where you live, but you might want to look at trying to get your money back in Small Claims Court. You'd need his present address in California for serving him, and you'd file it where if damage was done (your local jurisdiction probably), this is assuming your small claims court works the same as my local one does. No lawyers involved, just you and the party who wronged you. You want to look up the local rules for your area, on-line or drop by the local courthouse and ask the nice clerk. (Be nice to them, they take incredible abuse from people all day.) Good luck!

Did you pay by credit card? Most cards can reverse the charge if you can prove your case. It happened to me with a custom built bumper for my Jeep. I paid but the guy never came threw on the deal. My ccard got me all the money back.

don't bother getting an attorney. the amount you pay and everything, you'll end up gettin like 50 bucks back. it happens, at least you didn't get your car stolen or anything.

If you know someone in California you could have them protest with signs in front of their business. It worked for me!
