It seems to me the Congressional Black Caucus operates within a publicly funded institution and publicly endorses racist policies (advancing the well-being of people based on skin color at the expense of others) and yet is not challenged by the Fourteenth Amendment. What gives? Is this not the 21st century?

A caucus is basically a group of like individuals who stand together. There is the Republican caucus and the Democratic caucus. The Black Caucus is just the black members of congress getting together so it is no shock that they would push pro-black agendas. That might be why they were elected to begin with.

If the people who elected them are alright with what positions they take then they are well with in their right as elected officials to promote what they do. There are many Caucuses in the congress, the Black Caucus is just one. All promote a specialized agenda. So since the Black Caucus is doing the job that their constituents want, they cannot be sued.

You've got the fire in your belly for it. If you see that it needs being done- GO FOR IT! You've got nothing to loose because it's legal. Talk to a few attorneys. You may at first have trouble having one take your case, but they can refer you on to others. Go for it.
