In a nutshell. I'm a good father, she's a good mother(hmmmmm). She works full time, more hours than me. I make approx. 3 thousand more than her a year. She's also looking to relocate with the children possibly out of state. I 'm totally against it. I caught her cheating. Not once but twice. We have 5 kids.

Chances are not good in any scenerio involving this. First unless you have documented evidence (police reports, medical records, etc.), custody will be awarded to her, along with child support. You will probably get off with no spousalsupport. Now you will be awarded standard visitation rights which is good for you as you will then have a sayso in her relocating the kids, unless she really has one hell of an excuse for the courts to override you, which is not easy. If any or all of the kids are of a reasoning age (differs from state to state) you can have the judge ask the kids who they want to be with, although this may split the kids but may keep her close to all involved. Sorry about the divorce and good luck in your future

Your chances are vary good. The key factor is whats in the child's best interest. My opinion no knowing more than what you have stated in your question you will get AT LEAST Joint Legal Custody and she would probably be granted Physical Custody.

Usually the Judgment of Divorce will have a section that the children cannot move outside a 100 mile radius of their current residence at the time of entry of the Judgment.

If you have a good relationship with the kids its going to take a really great argument that its in the child's best interest to move out of state away from you.

No, it received't make a distinction. the only time it is going to influence that is even as they terminate his parental rights. finished custody would not recommend he loses his rights, it only skill you've your son one hundred% of the time, yet his fatherly responsibilities nonetheless stand. do not problem in case you document for finished and get it. Your newborn help might want to and could stand. BTW: there are some states which will nonetheless make the daddy pay up EVEN AFTER the rights were terminated!
