We live very far from each other. He calls me at times, Has only helped on occation, our 2 kids are out on their own and dont keep or even want to keep in contact with him. He is now in bad health and I want to be sure I wont be responsible for his bills if something would happen.

While there is common law marriage, there is no such thing as common law divorce. Once you are married, you STAY married until you are divorced. You can do this without his permission, and in some states, without showing up for a hearing. If you or he marry again without a divorce first, it is bigamy.

No. You have to file for a legal separation. Legal separation is a legal procedure which involves the courts and attorneys. Since you have been apart for such a long time you may be able to file for a divorce under abandonment. Abandonment I believe is being away two years or longer, but you say he has helped on occasion so I am not sure. The best advice I can give you is to contact an attorney as soon as possible. Unless you get a divorce, there's no such thing as a legal separation that would keep you from being responsible for his bills. You are still married until that piece of paper is finalized by law.

Your best bet is to consider legal advice. In some states, if you are legally separated for a year, it automatically becomes a divorce. However, if I were you, seek legal advice just to make sure.
