So friday we went to his patrents house and momz gave him his mail, why is it that his BM is trying to collect child support from him through the welfare office while their daughter lives with us,, mind you we plan on getting married, is it wrong for me to say FRAUD about her and for him to press charges?? Let me know

GREAT QUESTION! I was in the exact situation. My 17 yr. ol' daughter lives with me and my GF. My BM/XW filed for support and got it simply because shes the mom. I have been paying $538.50 monthly for almost two years. I have written IDPA child support division twice, I have filed two motions, had Three hearings/court proceedings only to hear "They made a mistake, I should be paying $598.00 bi-weekly. I even contacted The States Attoyney, Lisa Madigan (to no avail). All of this is due to my ignorance in the law. If I had known then what I know now!

HOLD OFF ON MARRIAGE FOR NOW (for legal reasons), Tell your BF to save any mail that came to your address in the childs name. If not any, generate some. If child is age 2/under, send off for $1 insurance with "Gerber", there will be a host of legal documents to follow, make certain doctor visits show your address. Order a s.s card/copy for the hell of it, and have it sent to your address. If child is in school be sure to use "your address" (crucial), also make him the primary emergency contact and his mom the secondary emergency contact. be as nice as possible to his BM while you guys get your **** together.
Then file a motion with the welfare office, when you get your hearing drop the bomb that she was fraudently collecting support. Sit back and wait for the state to reimburst you all/any money your guy paid out. Once this is settled you can start singing "WHEN WE GET MARRIED"!

p.s. you could then file civil charges for harassment, pain and suffering, and get this even "child neglect" for taking monies intended for the childs well being. Criminal charges can also be filed (normally by the state) However I did not go this far because of the CHILD. Afterall baby deserves a mom

no that is not wrong because if the child is in your care then she should be the one paying the child support if the child is not in her care there is no reason for her to even try and collect. I would call there and let them know what is going on and hell yeah he should press charges i mean baby mamas can be very vindictive and down right evil if they dont get what they want. So go for it go after the ***** and get her for child support unless their is another child involved.

You can not say a word about her.

You must go by what the court order says. If it says he pays child support he pays child support - whether the child is in his custody or not.

If custody has changed but not the court paperwork, it is up to him and the child's mother to change that paperwork in court.

It is up to him to work this out with the child's mother and the courts. It is up to you to be a good step-mom/fiance and gentle support of whatever his decision is.

If the child Is living with you then you should not her be collecting child suport.Let him read this because he Is the 1 that should collect the support

For sure, I understand you being angry. Their daughter lives with you at all time - why would he pay more? I can also imagine how your boyfriend feels!
You guys should sit down and think about this. I understand that you want to (and you should) get that woman to pay for her 'crime' but also think how this will affect his daughter? Her mom might go to jail... Good luck in dealing with this.

is it child support or spousal support.....what was the original agreement by the court? did they rearrange the child custody without the court knowing?
