lets say if im the only one who serves the food and cleans tables and has "direct table contact" how much of the tip am i entitled to? i need some clear facts to present to my employer so i can scare him into giving me my fair share. he is telling me that he plans to give a percentage to all the cooks inside, but isnt that not legal because they dont have table contact

Tell him to give all your tips to the cook, and you will take his salary

You mean the employer is collecting all the tips and dividing them up?

There's really no law about tips. The server should receive 15% of the tab.

Chicago my friend, your boss is actually right......it is time to leave. Some establishments will actually mandate that food staff pool all of their tips and then they share it with the people working. Some establishments will allow individual staff to keep what they receive. "Table contact" isn't required to benefit from the tips.

its all company policy. the only laws I know of is they have to compensate you if you are making under minimum wage after tips. I have never been a server though so maybe there are other laws, but i have talked to them about having to share tips.

just make sure you grab it before the bus boy, than you get to keep 100%
