I am filing for my divorce. But because I don't know where my husband is I have to file a notice by publication. I live in Chicago area and I do know he is in California, somewhere near San Francisco. So I assume I can post it in either state. How do I go about it and how much should it cost. Please specify state in answers.

there is no property involved and the children are his from previous marriage, not mine.

I've posted some information below to help you out with this. I think the first discusses publication if you're not sure of your spouse's location.

If you're still not sure, definitely get a lawyer.

If you are filing for divorce, from your question it appears you are trying to do this yourself. Unless you are trained in law, this is a bad idea.

You need to find an attorney, and have them file the divorce for you. This is especially true if there are children and/or significant property involved.

Filing yourself may result in you not doing something properly, and the court subsequently rejecting your petition. A court, if you are pro se (filing yourself) has to treat you the same way it would an attorney.. it presumes you know the law and how it is to work.

Save yourself some money and go hire an attorney. If you are without funds, you should contact the local legal aid society to determine if there are low or no cost legal services available. Otherwise, contact your local or state bar association for a referral.
