I am currently seperated my husband and I know it's not gonna work so we are waiting till he gets home to follow through with the divorce. I don't want to wait that long to have my maiden name back. I am lost in a battle trying to figure out who I am again and I can't carrying his name around anymore. I live in watertown ny and know nothing about the law or whatever so any advice is good advice.

I would have to suggest that you first go to the social security administration with proof of your maiden name and then go to the department of motor vehicles. I know for a fact that you can change your name back to your maiden name even before you finalize your divorce. good luck=)

A name change doesn't happen automatically when you get married, and a divorce doesn't automatically change it back - otherwise there wouldn't be plenty of divorced women who still have their ex-husband's last name. Call the probate office or local social security office and ask them the procedure for a name change - there's paperwork and all involved, and it may take a little time, but if that's what you feel you should do then I'm sure you'll think it's worth it.

when you file a divorce you must have a lawyer he will know the laws best because sometimes in some countrys you have to hold on till you are legally divorced, some countrys its easy to change your name by an affidavet in a court and then in a newspaper an announcement that you are legally changing your name

go to the social security administration, i believe its down off the square(i lived in watertown for 10 yrs, parents still live there) and ask for a name change form. they will be able to tell you the proper course of action. the numbers in the phone book i know, and sorry for the ending of your relationship. if you would rather talk to someone who has already done it, then email me and ill give you my mothers email, she just went through the exact same thing last year. she could walk you thorugh step by step, and lives in watertown

You can petition a court to have your name changed to anything you wish. However, in your case, it would be far easier to start a divorce proceeding and in conjunction with your legal papers that you file with the court, you could ask the court's permission that "during the pendency of the proceeding" that you be permitted to use your maiden name.

To change you name you need to go tho the Social security office and apply for a name change. take your current SSN card and marriage license, You should not have any problems. Explain you reasons for the name change only if they ask. Give as little detail as possible. Good Luck.

You get your name back the same way you changed it. Get another ID card with your maiden name instead of your married one. Notify one or two of your creditors advise them you are no longer married and have reverted back to your old name take your bills and a copy of your marriage license to the DMV to serve as other forms of ID and get a new ID.

Well i don't think you can until you are officially divorced. Then you nede to bring your divorce decree in to all the places and get your name chnaged back like on your social and your dl. Sorry. Hope that things start getting better for you.

I think you do it the same way as you got it changed to his name. You contact Social Security and tell them you want to change you last name back to your maiden. I think you feel out a form and that's it.

u will get your maiden name when u are divorce as long as u are still married to him u will have to keep his last name
