If I bought the original cassette, is it legally and morally ok to download the mp3 version?

Oddly enough, probably the answer is no. The issue is a copyright, emphasis on the word copy. If you were making a 'backup' copy of the cassette you bought, from the cassette, you'd have better luck arguing your point. However, downloading off the internet is taking someone else's illegally distributed copy. After all, you're not buying a license to listen to that song forever, you're buying a copy of that song.

The other question is, will you get in trouble for it? Well, probably not. Unless you download a lot of songs and the RIAA decides to make an example of you by suing you, you're probably okay.

Yeah, this is why I stopped buying music. I do iTunes, radio and that's about it. At least iTunes specifies how many copies you can make.

LEGALLY it is correct and proper for you to record songs that you have already purchased. You may copy these songs into another format, provided it is ONLY for your own use.

MORALLY it is okay as well. You aren't stealing from the artist or the record company. You already paid for the songs once. You are just converting it to a format that you can use.

If you sell those tapes or those MP3s then you are committing a crime and profiting off the sale. Morally that is stealing. Many people don't have a problem with that, but then a lot of people tend to ignore laws that don’t trouble them, like speeding or stealing MP3s.

So go ahead and convert them and keep the tapes.

As long as the cassette you own is a legal licensed copy. It also depends what country you live in since fair use laws vary from place to place.
