Please answer if you know anything about immigration. I have a friend who is not a legal permanent resident or a US citizen and only has a tourist visa. His main motive is to learn English better but wants to work in the meantime. Even if the job is a volunteer job he wants to work for something to do. So is it illegal for an employer to have him working as a volunteer? And are small random jobs like mowing lawns for pay actually considered something that you need a work permit for?

First of all, if someone works as a volunteer, you do not hire them; they come and go as they please. There is no employment and no employer-employee relationship. There is also no pay. As a result, it should be no problem for a person not authorized to work in the U.S. to be a volunteer. This said, immigration law is not the only factor to consider. Some organizations (for example, political parties) are not allowed to accept contributions from abroad. The work of a foreign volunteer, however, can be considered as a contribution from abroad.

As to "small random jobs", every U.S. employer is required to ascertain the prospective employee's right to work in the U.S. and refuse employment to those who are not authorized.

Well look at it like this. People are smart( with some exceptions).
So if i can get Julio and Jose to "Voulnteer" for things to be done and its "NOT" Illegal,,,, Well Well ill have a all "Volunteer" "Group" for what ever i need done. And there are places who would be looking for such a loophole to get "Volunteer" people. And of course they would "Vulunteer" on a regular Basis,Shift,Posisition. ect, and as a "Volunteer" if that get hurt "O Well" as there would be nothing to help the "Volunteer"

Volunteer job usually refers to non-paying job. As long as they are not getting paid that should be fine. Paying them becomes a problem.

I am not a legal expert so do not consider this legal official advice.
