The Illinois decree is less than two years old.

The decree says my son and I can live in Texas. We have lived here for over 18 months now. That's not the issue. The issue is getting the decree's jurisdiction moved from Illinois to Texas. Does Texas have to accept the decree before I can ask the State of Illinois to give up jurisdiction?

If the divorce is already final, then the only issue is child custody/support. In order to modify that, you'd have to follow the guidelines of the Uniform Child Custody Jurisdiction Act. Check with a local attorney, but the short answer is.... very, very tough to do.

Ex will have to agree and Texas will have to accept the case.
