Wow what a question. On the one hand I say no. Our court and jail system can't handle drug traffickers and child molesters. Imagine what chaos would be caused trying to handle adultery. What would the punishment be? 1st timers get 10 years? On the other hand adultery is a crime that is wreaking havoc on our society. The pain of children growing up in broken homes is devastating. a large style of people right here look to assume that the purely reason antagonistic to adultery is faith, which isn't superb; there are a range of secular motives antagonistic to it. So i do not imagine the church vs. state argument flies right here. yet, as others have suggested, i don't recognize that making it unlawful can provide up people doing it. If people are not positioned off by skill of the titanic social stigma, the possibility of their better 1/2 sorting out (and in all likelihood leaving them, and absolutely replacing the nature of their courting for sturdy), hurting their little ones (in the experience that they have got them), i'm not particular illegality may positioned them off, to be elementary. also, i'm not confident that legislating people's relationships works o.k..

After reading every answer posted, I still haven't found a decent argument for it being illegal. Should it be grounds for divorce, obviously. But why should it be illegal? Do we really need to legislate the morality of our families? Are we so inept as a society that we need our government to control the way our families interact?

It is illegal and grounds for a divorce.
Being married is a legal contract and the contract is broken if you cheat on someone.
BUT..only if you are married.

No it should not be illegal. People should be more careful who they marry. A man who marries a lady and falls in love with another cannot necessarily get a divorce just because of this.
Divorces must be granted. They are not just... I'm tired of this..boo hoo hoo divorce.
It's a complicated and expensive process.
not to mention it makes it a crime to have sex with someone else. Sex is not criminal.
Once again, people want to solve with legislation what is a social problem.
Legislation cannot uphold your morals for you.

Um sure...a contract is broken. But you can't force anyone to remain in a relationship if they don't want to be there.
Adultery is generally grounds for a divorce. Would you want to stay in a relationship/marriage with someone who would not take his "contract" or vows seriously?

I think it is a sad thing when we have to ask the government to legislate our morality. You should decide within your personal relationship what is okay and what isn't, and when one party steps out of line, we should have moral guide lines that define our course of action. Of course many people can't seem to handle thinking for themselves. One person might define stepping out of bounds adultery while another person would not. In this situation do we blame the government for not teaching the person well enough or do we look at the people who raise them?

oral contract??!!depends on whom is sucking on what and why..lol.. Jk.. YES and it is in most states..Adultery harms many..in many ways..it is never a good thing... in polyamorus and open relationships no..comlicated issue with no easy answers but generally no.. I was married to an iceberg for 14 years and never cheated..I should have..it was pure torment from a woman who to this day claims to be a "good christian woman"..I've known satanists that had better morals than she did and does to this day.

It is illegal under tort law. It is not a punitive event. But it is in violation of the marital contract and is grounds for divorce.

Adultery is illegal and is on the books in most states. Good luck finding cop to go arrest somebody for it though.
