Will was filed with the court end of 2005. In Texas my understanding is that the will has to be probated in 2 yrs. Executor not wanting to probate because he doesn't like the dispersements set in the will. Can he indefinitely put off probating.

get a lawyer and sue him for failure to do his legal duty

Most states will provide procedures to remove the executor if the executor is fulfilling his or her duties. It also may be possible to have a new executor appointed. However, the laws will vary from state to state and you will need to consult a probate attorney.

Have you taken issuance of this concern to him? If not do so immediately - in writing (and save a copy!),notorized, and explain to him what you expect to see happen within the accorded timeline. If there still is a lack of responce on his part, then yes the courts can issue arbitration on this matter, and if that is not possible than there is always legal action that can be pursued. Usually the threat of law-suit will spur people like him into action, but be certain to follow the protocols I mentioned to protect your interests legally if comes to a law-suit. Remember the general precepts of "jurisprudence:" due notice, due diligence, due process, and due respect...follow these, live by them, and your troubles will "disappear."

legal speaking . you can have the one name over this estate removed this only takes .1. year with all bills paid by this prson and if there is a will something isnt right . this is fact. ?
