You should talk to a lawyer about that. If you've already filed for divorce, ask your divorce lawyer about it. It probably depends on how long you were married, because that will determine whether or not your ex is entitled to support from you after the divorce is final. If not, then you won't have to share the disability. But if you were married long enough that the law says you're obligated to continue to support her ("alimony") then you might have to give her some of the back pay, and maybe even some of the pay yet to come (worst case scenario). Ask a lawyer so you know for sure.

I would like to differ w/ all of you, maybe in Ky it's different, but in NY it's like this, I'm on disability myself, my soon to be ex-husband is on it also, Socail Security told US that disability is for the PERSON that recieves it, and ONLY that person, regardless if you get it while you are married. Thats in NY state though, I'd see Socail Security and a good laywer though

Unfortunately Yes . Any money you accumulated while married is community property. Even if it is a back payment.

yes, until you die, or she dies she gets half of everything, pension, ssi, land, cars, savings,homes, everything..
