Depends on the state you are in... your local DMV can tell you for sure... If you registered the vehicle in the last couple of years and it passed and you did not know there was a problem since then it is buyer... if you knew that it would not pass and did not tell the buyer then you are responsible.

as long as the current tags are not expired I would say the buyer ,
