I have one previous misdameanor posession charge and one previous felony not associated with drugs that I successfully got deferred. I'm doing rehab, AA classes and community volunteer work to help sway the judge. Would this be enough to keep me outta prison (one of the felonies is a 1st degree for mushrooms, the other two are 2nd for weed) and whats the possibility of getting the three felonies on deferred probation?

I never said that i'm trying to "fool" the judge, I want to show him my dedication towards a new life. Im more honest than any other guy I know. I have an addiction problem and yes... I am scared sh*tless of going to jail and will do anything necessary to prove just that!

It depends on the state that you're in.

Some states have adopted a fairly harsh line for felony drug charges, and the chances of you getting a deferrment, especially on 3 felony charges, is slim. Others, if you are not charged with distribution and/or possession near a school, etc, you may have more of a chance.

You need to understand, that IF you find yourself defferred, and you screw it up again, the chances of you avoiding a very long prison sentence for a subsequent offense is essentially zero. You are on what we would call where I am a "border box" of the sentencing grid. The rehab, NA classes, and volunteer work are nice, but the fact is, you obviously didn't learn your lesson the last time you were in trouble, and now you are in trouble again.

I think that if I were sentencing you, I would probably give you 90 days in custody as "shock time", because I want you to understand that this is not a joke, and that the system is not going to give you any further breaks, and then I would give you the maximum probation that I could do under the laws of your state, with the sentences to run consequetively..(one after the other). I would also order "intensive supervision" for at least the first 3 to 5 years... meaning, random and frequent drug testing, monitoring by the probation department, with the understanding that it won't take more than a bad sneeze to get you violated. You might think me harsh, but the alternative would be worse.

dude you ever think about stopping the ********. all the crap your doing is just to get over. and if the judge gives you a shot what are you going to do? start getting high again? you need to clear up your junky mentality and get you sh1t straight. try not to progress to harder drug or you'll end up dead. and prison is no joke either. you don't want bubba's girl tattooed on your back. you have to change your whole life style. you should be trying to clean up your act instead of trying to fool a judge. you may fool this one, but not the next one. the choice is yours. good luck stay clean.

I wouldn't count on it. The judicial system sucks. My son was in a similar situation. They give more prison time for drugs than they do sex crimes. I hope you have a lawyer. If you do get deferred it is a gift from god, use it wisely. Will keep my fingers crossed for you.

Ouch, I feel for you man.

I cant answer your question, but I can say your situation just shows how silly and counter productive our current anti-drug laws are.

Good luck. And maybe you should contact groups like NORML to see if they can offer some legal advice.

You have a good chance of staying out of prison IF you can get attorney because non of those are narcotics. BUT withuout an attorney it would all come down to what type of judge and DA you got.

Are these distribution charges, or possession charges? Distribution basically = Prison, Possession you could possibly get probation.

Looks to me like your getting close to the 3 strike rule, go to jail for a LONG, LONG time!
