...... her income plus her current husband's are much higher than mine. Does anyone know whether her current husband's income would be calculated in Florida ? They had a lavish lifestyle and spent all their money with brand new cars, now she claimed she is not capable to pay the attorney's fee by taking me to the court and requested me to pay, what am I suppose to do ?

I don't think his income would be calculated in. But it can't hurt to bring it up...contact your lawyer.

I'm not sure about Florida law, but in Pennsylvania, if either you or your ex-wife get remarried they include the new spouses income as far as the calculation of child support. I say if she wants to take you then let her because she'll probably end up losing child support money....plus SHE has to pay for the hearing(as long as she requested it)

Find documents proving that they have a higher income, though technically her new husband isn't required to support your children. You could get out of alimony payments by arguing about his income. So stick to proving your ex-wife earns more than you. You need a lawyer and a court order probably to get her to state her income.

Sorry about your luck. Noncustodial fathers that try to do the right thing are often the victims of vicious exwives. Grin and bear it, but don't set your children feel your pain. It is not their fault.

I wouldn't pay her an extra dime. Let her spend some of her money on a lawyer if she wants your child support raised.

Well its not her current husband's place to pay for your children's exspenses. I do advise for you to get a lawyer though. I do live in Florida and thats what they would tell you.

Get a good lawyer. If you're already paying child support and it percentage of what you make, then she can't get any more then she gets now.

Request a reduction since thier incomes exeed yours & also request for her to pay.Or....... requset a change of custody & make her pay.Things are slowly changing.

YES THE COURTS IN FLA WILL COMBINE HER N HER NEW HUSBANDS MONEY,U SHOULD NOYT GIVE HER ANY MORE MONEY,U TAKE HER TO COURT.GOOD LUCK.
