i went to court for a custody battle with my ex and my lawyer said i did not have any money left, and walked out, i never recieved any notice that i was running out of money or needed more she just walked,

ok i see this part " my lawyer said i did not have any money left, and walked out i never recieved any notice that i was running out of money ". they dont work for free.how can you not know your out of money ? ask for a delay to find a new laywer. or face that he/she just won the battle. money rules the world.,

10 Min's before court? Hmmm, even if you didn't know that your retainer was almost gone,(which happens when their is poor communication between the attorney and the client), let's think about if SHE knew that your retainer was going to be depleted TEN MINUTES BEFORE COURT, and did not communicate this to you, or at the very least ask you for a check? Somethings definitely awry.

If your attorney does not think that you can come up with more money ASAP, then it only logical conclusion is that she doesn't want to handle your case.

1.Ask the Judge for a delay.
2.Find new Council
3.Go to the ABA.

I'm going to agree with what the others have said because I also feel that you should, at the very least, talk to the American Bar Association about this. If she had a problem representing you, whatever the reason, she should have told you before the court date.
Don't just let this go without talking to someone.

Report her to ABA!!!! The money issue is something that you should have know about but with the fact that lawyers are pretty tight lipped about their spending habits in the research for your case, she should have given you notification.

The fact that she left just prior to your court date just further proves ineffective counsel! There are guidelines for attorneys to follow & punishments for violating. I would suggest that you contact American Bar Association for more details. Ask the judge for a continuance & then pray!

Yes, Report to ABA, and to Martindale-Hubbard, which rates lawyers. And you have a legal malpractice case.
