I want to start a small organization consisting of around a dozen members. However it may expand to 1000s in a few years.

How do I protect the organization name and reserve the rights for that name only to ourselves.

Currently, our organization is only a group which would meet regularly to discuss ideas and future possiblities. We won't be earning anything. Later on, we might start earning.

What do you think would be the best thing to do? Also, please provide a step by step method how to go about the official formalities to protect the name and start the organization.

In present time, the only way out to preserve the name, identity and other related aspects is to have the legal recognition of the whole matter and keep that legality valid on perpetual basis. Besides these legal registrations, whether trade marks or patents or any kind of IPR or registration of names, styles, even colour schemes etc; the other ways out are quite risky to follow and can any time be defeated by a smart adviser, lawyer or entrepreneur himself.

You plea of no earning at this point of time, and probably inability to spend for the purpose now won't serve any good as the government, other agencies and service providers won't extend you charity or credit on this account. You may find a financier for the purpose of your own and go ahead with registration etc.

You can always weigh the viability of the proposed activity and come forward to make minimum investments if you are so sure about its success or even sell the idea if there is any taker!

Trademark or service mark the name immediately.
