Despite what some would like you to think, it is legal to burn CDs. Why else would a computer come with a CD recorder built in?
It's perfectly legal for you to make copies of your own music for your own personal use. It's called 'fair use.'
However, if you make a CD mix for a friend, to be completely, technically legal, you'd also have to give your friend all the CDs you used to burn the CD; and technically, in your example, if you make a copy of your friend's CD, that's illegal.
The law continues to be a bit fuzzy.

In the eighties, several record labels released tape (cassettes) version of albums on 90 minute tapes, with the LP on one side, and the other side blank. The tape itself was labeled on the side with the LP, but the other sides stated: "Home taping is ruining the Record Industry. We left this side blank so you could help." Recordable technology, such as tape, digital .mp3, and recordable audio on CD will always be claimed to be ruining the record industry.
On the other hand, when you purchase a CD, you have the right to make copies. iPods and other .mp3 players work on the principle that you can make a copy of a song on a CD and load it to your player. My 10G Archos currently has copies of songs from what I can only estimate as 100 of my CDs.
Laws against copying CDs are generlly designed to prosecute individuals or groups who make a practice of making multiple copies for sale purposes. In this case, however, your friend is only refusing to burn it for you. Why not just ask to borrow it, and burn it yourself?
Rules are not designed soley with the pupose to be broken. Whatever you think you believe, you would have no real desire to live in total Anarchy. Rules are sometimes mis-interpreted, sometimes unjust, and sometimes not very well thought out and enforced. But at some point, these rules were seen as the best solution to a problem. In this case (copyright), it is a combination, but the idea that someone else's intellectual property should be protected is not wrong.

If record companies went out and prosecuted everyone who illegally downloads music and burns CDs (basically the entire USA), they would lose a lot more money than they do from people just not buying the CDs. Unless you're sharing 20,000 files on Limewire, or making a lot of money from selling burned CDs, you're not going to get caught and thus you're not going to be punished.

Relax! I agree w/ most others who posted..... It is perfectly legal to burn a CD, providing that you own the original CD. You are allowed to make a copy of that disk, or as many copies as you want. However, it is illegal to sell CD's for money...... That's a no no...... I wouldn't worry about getting caught!!!! Everybody does it.......... OH, and stay away from Limewire. Ughhh.......talk about illegal.

Look, burning CDs is not illegal. Burning them and then selling them, that is illegal. Once you have bought a CD from a credible source, then you are the owner of the material on it. Burning copies and "giving" them to friends isnt illegal, but selling is.

some people feel that it is akin to stealing.
some artists dont care if you copy their cd because they want as many people to hear them as possible
some people equate legality with morality
it all depends on the situation.

It is considered stealing in the Law of Moses and in today's law. Stealing is stealing whether or not someone is caught.

I live in the UK and a few months ago people were fined heavily for doing this ,and believe me they know what you are doing,and where you are.
