If this was just walking up behind someone and resting your hand on their neck you will probably just get counseling the first time and be scheduled for sexual harassment seminar.

More than likely, not. If this is a first offense of such a nature both you and your coworker will probably be questioned, maybe by a company attorney. You'll probably get an incident report in your employee file, as will she for making the claim. If this is something that continues with either of you there will be a documented pattern and then you or her could lose your job.
To my knowledge, unless you raped her there is no jail sentence for sexual harrassment, just a bad employee record and possible dismissal from the company.

You should be given a chance to explain why you did what you did.
Any unsolicited contact between genders can be construed as inappropriate sexual contact.
You will probably receive a warning and a lecture about correct behavior in the workplace, then be asked to not do that again and not to her.
If there is a repeat of this or a similar action, you can be terminated.

Yes, but, you might 'fall, up the stairs' a few times, on the way!
Then, you will get to be in a nice cell with Bubba! Bubba has an IQ of 85, and is 6'3" tall. Bubba weighs 430 pounds, and smells really bad. Like old, sweaty socks soaked in urine and left in the corner of a wet, muddy, fungus covered basement corner.
Bubba gets to wear Overalls, due to his huge size, and a greying tee shirt. And, he also smells badly of rotten teeth and nicotine from his nasty 'pack a day' habit...
He will ask you if you want to be the 'wife' or the 'husband'.
Then, he will tell you to bend over...
You'll enjoy your two years with him. You will become quite close. You will even get usedto the smell, so you only notice it late at night, as it rises to your upper bunk, late at night, as you try to sleep, even though your butt is sore.

Is her neck all you touched? Did you also say anything? No jail time for you but getting fired would be a definite possiblity.

First why did you put your hands on her neck. Because you should know better. The most they can do is fire you. I really think she needs more evidence to put you in jail...

There are cheap plastic dolls that may help you release that anger, you can call that doll anything you want they wont sue you becuase they dont have souls. Humans have souls and deserve respect, I dont think your going to jail for that, but you should apologize to her in front of many workers and that can help your conscience heal and also her reputation.

Did she call the police? If not, then you are probably not going to jail. You may lose your job, and then again, you may only be told to keep your hands to yourself. Technically, it is an assault, not necessarily sexual.

Did she express to you that she didn't want you to touch her neck? Did you apologize? If yes, fight it. Call the ACLU if you have to. I won't go near an office for a job because you can scratch yourself the wrong way, and someone will use it against you.

Sounds like she wants you fired. Not a jail offense, depending on the state. Could be called harrasment though.
