I am currently divorced and pay child support to my ex-wife. She and I both work. Later this month she will be getting married again and will not be working due to her future husbands financial success and income. Will this change my support payments when they are reviewed again? I realize this probably varies state to state. I live in Ohio.

I was divorced in Ohio also.

Child support is figured by adding your income and your ex-spouses income together...then figuring for a family of that income how much is spent on the children. The you pay your percentage of that amount.

So...if you make 50,000 and your wife makes 25,000. They figure that a 75,000 household spends say 1,000 per month for a child. Since you make 67% of the income, you would have to pay $670, if she had the child 100% of the time. If you have the child some of the time...then your payment to her is less depending on what percentage you have the child.

If you wife is not working, your 50,000 is 100% of the income...a family making 50,000 might spend say 750 per month on the child...and you would have to pay all of that. Again, reduced by what percentage you have the children.

Of course, if she is doing so well now, she might not go back to court, and the support order would not change.

In Canada, child support is measured primarily by the payor's income. If your income hasn't changed, it isn't likely the child support payments will (unless the payee has an income of her own of $150,000 or more - then there are certain rules here). In Ohio, I don't know what the situation would be, but you need to speak to a lawyer to find out if her personal financial situation affects your support payments ... but then again, if her spouse is as rich as you say he is, one would wonder how much longer your obligation to pay at the current level would be, esp. if he takes on a guardianship role for the children.

in most states if the custodial parent re marries and stays married for over 3 yrs the non custodial parent can actually ask for teh support payments to end. That is of course if the new husband's income is included into the equation which some states don't really do. But you can call your Child support enforcement unit and they should be able to advise you better.

Most states that I am aware of, including my own, if a ex-spouse remarries her new husbands income IS NOT considered in figuring child support payments. My ex married a brain surgeon, $750,000 per year income, my support payments did not change.

i dont think so i live in nc my friend is get childsport for her son the father lives in fl but she stop working to go to school and it didnt change his child sport she tryed to get more out him but steal only had to pay the $50 a month they told her the only way that would change is if he was adoted but her new hubby the he no long have to pay she have to get him to sign over rights or he got and high paying job lol he was working and good paying job now he working and fast food place so he dosent have to pay high child sport i know both them well he was my best friend but i stopped talking to him couse his way of not seeing his kid and trying to get out childsport if u remarrie or have any more kid her the child sport well go down if u have to take care of other childen liveing in the home also u can have it set up were u get the kid and week and she gets the kid and week and u or her dont have to pay child sport
