We (my band) are about to go into the studio to record an "album", however there is debate over wether or not it's an EP. We are going to record 6 tracks and include one track that we've already recorded a while back (which in itself is about 7 mins long..) So, we have a disc with 7 tracks. The total length of the disc will probably be near 40 mins or so. So, the question is, is this an EP or an Album? To give you an idea, the album "Wish You Were Here" is 5 tracks, but just over 40 mins. So it's an album. So, is an album decided more on actual time length or on amount of tracks? So, 7 tracks, just under 40 mins: Album or EP? (is this making any sense?)

Yes and you need a length of your album to be about one hour-one hour and thirty mins.

EP stands for Extended Play for those that may not have known. In the case of an EP versus an Album an Album in it's pure right is based on Number of songs not length of songs. Usually 10 or more tracks equate to an Album with each track a minimum of 3:50 at least that was the rule of thumb when I was younger.

There are a couple of early Van Halen albums that are 30 minutes but they contain 10 tunes. Generally extended plays (EPs) are 15 - 25 minutes and contain more than 4 tunes. Single long play (LP) albums are 25 - 80 minutes.
There are exceptions and people can list Marilyn Manson's EP that is 54 minutes, but this is a general rule that is not set in stone. There was an Ozzy Picture disc that had like 6 tunes on it and was over 30 minutes back in the mid 80's but it was called an EP.
Check out Sabbath's first record that has 7 tunes on it (US).
I'd say you are releasing an album.

Over 30 minutes is an LP/album, over 10 minutes is an EP, and under 10 inutes is a single.

It has nothign to do with how many tracks you have, It's all to do with length of play. Your recording is an album. There have been albums containing only one track.
