There is a known subframe issue with the e46, particularly if you have an aftermarket suspension or race the car. There are kits available to fix the problem - check out this thread for more info:

OOhh, expensive. Why did this happen? and as for the repair, you're likely looking st the removal of the rear axle, and your welder needs to be a really good one, to get the position critical suspension location points in the right place, when he cuts out and replaces the affected metal.
Needless to say, this shouldn't have happened. Was the car drastically lowered? is it a very old one, been parked in wet grass for years? Any accidents? Maybe it's a write-off.

By the sounds of it, its knackered but the you did say BMW . Try vinegar & brown paper then the repair wont be so noticeable!
