Yes and no.
A cuban cigar which was imported to this country before the ban can be legally sold by a tobacconist, as long as the other laws relating to sale of tobacco products are met. These cigars are often quite expensive, as you can imagine they are also quite old.
A cuban cigar cannot be legally imported into the United States. This means that if you go to Cuba, (which is ALSO illegal in many cases) and you bring back a box of cigars, they probably won't arrest you, but they will probably confiscate the cigars.
Having tried cuban cigars on travels to other countries, I can tell you that there are, quite frankly, better cigars made in non-banned countries these days. Many are grown with tobacco plants which were imported from Cuba. The reason for the decline? Mostly it is because of the declining cuban resources to produce quality products. This is less true now, because the US is the only country that still maintains the fiction that if we don't trade with cuba, Castro's regeime will collapse.

Sure, if he owns one. What he can't do is import one from Cuba. I brought in a whole box of Havanas that I bought in Hong Kong, which isn't under the ban. Gave them to a friend, but I could have sold them if I had wanted to.
