You had to ask a lawyer? Of course it is stealing. Semantics aside, it is also morally wrong.

Stealing is depriving the rightful owner of the value or benefit of property (tangible or intangible).

Taking some thing from a store without either (i) the store's permission or (ii) fairly compensating the store IS stealing.

Even "borrowing" something (without permission) with the intention of returning it later IS stealing.

Likelihood of getting caught does not change the answer either (although it can be done without detection ... it IS still stealing)

If you took it without getting permission then even if you intended to return it at some later date it would still be stealing. You would be depriving the owner of it and treating it as your own.

Theft is theft and has nothing to do with borrowing.

Sure is. It falls under the statute of Theft by unauthorized taking or transfer. Depending on the value of the stolen item, the calss of crime can be a misdomeaner or a felony.

Morally it is wrong to steal, but 97% of Americans have stolen something in their lifetime.

Good luck to ya. I hope you aren't a theif because a lot of criminals go bad because of theft/drugs.

If not stealing what else would you call it. Any thing taken from a shop without permission and without payment is a theft and subject to legal punishment

Whether u intend to return it or not , once you walk out of the exit without paying it, you will be charged from stealing.

Yes ofcourse it is. You have to buy it to not be called stealing. I hope you didn't think its called "borrowing" IF you didn't ask and they don't know you took it its stealing.

If some one takes something from you, with out you knowing it, like your car, or wallet..and "maybe" gives it back...
