My girlfriend and started our relationship on february 7 2004. In may of this year we got into an arguement and I asked her to leave and take our six month old daughter with her. The plan was just to take a break but it escaladed through family interferance and we ended up filing custody and visitation petitions against each other we were in court six days after we split up and we got back together after court that day and have been back together every sence. we want her and the baby to move back in but we dont know what to do. her lawyer wont call her back and I dont have one. HELP!!!

I have had a lot of dealings with custody battles in family court due to having my sisters kids and other friends with their family court issues. This is in new york mind you. Any ways , in my experience all you need to do, both of you is write a letter to the judge and have it notorized that you wish to drop the proceedings explaining the 2 of you have worked things out and that the only order you would like her to issue is joint custody of the child. If the judge hasn't acknowledged your letter before your next court appearance, both of you need to appear and explain the same thing in person. As long as you don't have social services involved the judge should without any problems dismiss the case and just order the joint custody. Hope this helps.

Be careful about doing anything without the knowledge and consent of the court where you are filing. Get a new lawyer if all else fails. You don't know what protective orders have been entered and which you might be violating by moving back without court consent now that you have started the court case.

well if you want to be together then just do it if you both agree then their is no problem
