It makes no difference who's name is on the home while you are married. The problems come if you divorce. If her name is the only one on the home then you will have little grounds for trying to get anything out of it.

The difference is ... was the house hers before the marriage... if it was then only thru the court deciding and the law stating that she has to share it unless otherwise stipulated you dont get a dime.
If you live in florida you have to share the house and the liability no matter whose name is on it because you are married. FIFTY FIFTY in florida... Most states are different. You have to get the info from the state government.

I'm not real clear on your question
But I believe your talking about your sister and her ex boyfriend??
There are several factors to consider.
Does she OWN the house?
Does she live in a "Community Property "state?
Were they living together BEFORE she got the house? ( long enough to be considered legally married )
If she is LEASING, and she is the only one that signed the lease, there would be no question as to whether he could not move back. It would be out of her hands, and up to the lessor, or manager.

If you're married it won't matter whose name it is in. You're entitled to half. You will def. be able to get 1/2 the equity if you put money into it also. You can go on any legal website and find that out.

Depending on financial status, it may help your situation,depending on
the amount of time you've been married, it is community property. but be a man about the situation.

If it is in her name only, then it is entitled to her and her only.......Sorry, that's just the law.......Take care
