I want to put his name on the birth certificate but because they weren't married the father has to sign an affadavit that he is the father. I want to know if I can sign for him some how. We want the baby to know who his father was!

If you and the baby's mother get along go with her to the doctors, and hospital with her, then when they ask have her or you can tell them.
I'm sorry that this happened to you that your son passed away, my cousin was in a motorcycle accident and died while his girlfriend was pregnant with his child.
Also offer it to your higher power and you will find the answer that you are looking for. Smile,

it is the right thing to do! just because his dad is dead, he is still the father. why are you questioning it?. just do it your son one day will be ever so grateful that he knows his real dad, tell him and show him who his daddy is. that's what pictures are for "beautiful memories".
