Yeah... if the person is on your property and it is a life threatening situation, you can't go out and chase the person down!!

It is our right to bear arms, possess a weapon, in the United States... however that law was written during a time when new Americans were fighting for their freedom from Britain.

You technically are responsible for how you choose to use your weapon/firearm whatever... and therefore are completely responsible for whatever results from your use of your weapon.

My personal OPINION? No, you have NO right to use a weapon on another human being. By doing so, you are no better than the hooligans who jump your brother. Get the police/authorities involved and let THEM mete out justice, not you.

If you permanently mame or, worse, kill someone you have to carry that around with you for the rest of your life... AND, more importantly, face some heavy duty lawsuits from the person or the person's family for any harm you inflict. Thieves who have broken IN TO someone's home have successfully sued homeowners and won damages due to their injury. How's THAT for our justice system? My point being, if someone comes after you later, legally, the fact that the guy was jumping your brother may not be enough for you to come away 'innocent' from the situation... and you may find yourself in jail or with a huge suit payoff to the plaintiff.

Don't do it. It's not worth it.

It depends on the state you live in and that state's self defense laws. It is uniformaly held that a person can use the same force to protect another that they could to protect themselves. So the question is can you use deadly force. The answer is if a reasonable person in the same situation as your brother believed that deadly force was being used against him.

But in some States there are duties to retreat before the use of deadly physical force. So we have to know a lot more details before we can answer the question you posed.

Nope, that would be assault and battery with deadly force. If the person dies you will be charged with murder. If your brother is in the process of being attacked you can restrain that person but you cannot use a weapon unless the attacker is using a weapon and then it has to be of the same force. Your brother should have these folks arrested for assault and battery or have a restraining order on them.

goku3000, you will probably receive answers of yes from people. And I know frankly, my response isn't smarter, or tougher than anyother's. However, you have to think this through for yourself. All I want to do is point out some stuff to remember...
1. If it isn't you who is in danger, self defense may not apply
2. Do you know how far these pricks will go to settle a problem?
3. What would happen next if you did get them back?
4.Would they retaliate?
5.Could it get even more brutal for their next victim?
6. Like you or your brother?

Your legal rights generally depend on what state you live in. Look up packing.org, lots of good info for every state. In the end you have to decide if you're willing to face the consequences to defend a member of your family or yourself.

Technically, you can't get away with shooting someone that is on your porperty unless they have ENTERED your house. So, I guess my advice would be to try and drag their butt into your house, and then deal with it. Try and get the police involved though if you can.

Why would you want to go to prison? Call the cops and let them do the dirty work. Do not jeopardize your life and freedom.
