question is, who opened it? after fedex dropped it and before you even saw the package? if fed ex dropped the package and the contents where stolen before you got to the package then you can go fedex. they have a small claims insurance plan that depending on the severity of the claim there insurer will pay for the lost items. if this is a matter of the person that opened the package is your worst enemy, then small claims court or even a local claim through county attorney can be done. the fact is...it is still an offense to take/open mail that isnt yours. wether it is family or not, doesnt matter. if your name isnt on the mail then leave it alone.

If you are referring to criminal action, then it is a theft (depending on what state you live in, it may be called, theft, larceny, conversion, etc). If this is the case, then you begin the proceeding the same way you would any other proceeding which is to call the police and report the offense.
If you are referring to civil actions, then you can either hire an attorney who can file a suit on your behalf or you can do it by yourself (Pro Se). This can also be handled in small claims court. (Depending on how much the item was worth)
Generally, you can seek replevin or money damages from the person that took your package. This taking of your item(s) is generally called conversion (in civil cases) and again, court action is generally necessary to get it back absent the person voluntarily turning it over to you.

I am not sure if this applies to FedEx packages, but if someone opens your USPS [Postal Service] mail, it is a felony and you can get a lawyer and take them to court.
Since FedEx isn't a government body, I'm not sure how it would work. Was the package signed over to them?

FedEx requires a SIGNATURE before delivering a package. If the person who signed was NOT authorized to do so, you can sue them. Fed Ex was also responsible to verify if someone other then the person to whom the package was mailed signed for it, so they have responsibility to you also.

Contact the US Postal Inspector for the area you live in. File a complaint with Fedex too

You call the police and have them charged with theft. If the package was sent from another state, you might also be able to charge them with interference with interstate commerce.

You have to prove 2 things
1) what was in it and what it was work
2) the the person took it
you may be mad but as best your get the value of the goods, no more.

check w/your local postal office they will be more helpful.i am very possitive that is illegal&punishable by the law.it is also a federal offense because the postal service is of federal origan.
