Not necessarily. Open container laws were put in place in many states to reduce the burden of evidence and make the mere presence of an open container an offense. A lack of this does not mean that drinking and driving is legal, however. It just means there may be other charges available that require a higher burden of proof, such as DUI/DWI that require testing.

There is no open containers in the passenger or driver side of any vehicle, nor any open container in public areas like beaches or parks. I found out the hard way.

no passengers can not drink in their cars at all! drinking and driving is against the law and it's no excuse that you didn't know that!
