LEGAL SEPERATION IS DONE BY A LAWYER. YOU HAVE TO BE SEPERATED FOR A YEAR BEFORE GETTING A DIVORCE. THAT MEAN NO CONTACT WHATSO EVER. NO SEX . IF YOU HAVE SEX WITH THAT PERSON THE YEAR STARTS OVER. YOU ARE NOT SUPPOSE TO HAVE NO ONE ELSE BECAUSE IF YOUR SPOUSE SEES U WIT SOMEONE ELSE WHILE LEGALLY SEPERATED THEY COULD GET YOU FOR ADULTERY.

Lets see if I can answer this easily. Its like a trial divorce. One party really doesnt want a true divorce but cant seem to live with the other so they seperate via paper and sees if this is what they truly want. It is also a way to work out any marital problems to try and avoid the divorce. Not always the best solution but both are still married, and if all works out, theyre still married without having to get divorced and remarried. You really dont need a divorce atty until one of you files for actual divorce. Hope this helps and good luck to you both

A legal separation does need a lawyer. A trial separation doesn't need one. If you want to separate and have the time count toward divorce separation, check with a lawyer's office in your state. It depends on the state as to whether or not you need a "legal document" for the separation to count toward divorce.
I separated from my husband in May and in my state, I only have to be physically separated from him, not on paper.
I'm still trying to work on my marriage. I'm not ready to divorce yet. Hope things can be good for you soon.
