The person who has the kid has custody. You don't even know where he is. How could he have custody? "Custody" means that you have the kid. Clearly, he doesn't have the kid.
If you're concerned about legal issues, it doesn't sound like you've got too much to worry about since he has moved away and not bothered to let you know where he is, so he must not be too interested in being a father. If you're worried he'll come back and try to get the child, talk to a lawyer now, and get an order on file.

I beleive the mother has custody unless it is proven she is unfit such as cant take care of or she has a drug alcohol problem.You say father moved away and no one knows where he is at does he have the child?If so that can be kidnapping.If the mother has the child and he left then I would go after father for child support.

I guess you do. The father wanted someone else and he got out of town before you file for divorce and child support. You have his social security number got to the local child support inforcement agency and file. Get an attorney get a divorce on the grounds of abandonment then ask the courts to sever his parental rights. Make it so he can never see his children again with out supervision.

Here where I live if you wasn't married nobody has custody and you have to draw up papers with the courts to say so. If you were married the mother has custody until the divorce is final and a judge says other wise.

The parents have to decide amongst theirselves who keeps the child if they cant decide then legally the have to go to court to gain costedy of child but that is a last resource i personally think the kid should chose but again the law says go to court for legal custody

Who ever has the best lawyer ends up with custody.
The mom does not automaticly get custody because he moved away.

She needs to go to court and file for physical custody if that is the case...otherwise there will be problems later when dad returns.
