my garage occording to my neighbour is built right on the boundary of our adjoining properties and thats where he says the new fence should go. However I say it should go 6 inched further back as to do it his way would mean the gutter on my garage is actually overhanging his property--I didn't think this was allowed.
Anyone out there with any knowledge of boundary fence regulations.

Boundary dispute alert! - These are never straight forward.

You need to check your deeds to establish where the boundary line actually is. Gutters shouldnt overhang the boundary line, but if they have always been there then there is little that can be done.

I suggest you check with the councils plans to get clarification of the boundary. I know our council allows the brick wall of a garage to be the boundary line but not with eaves. If eaved on that side it has to be the minimum distance away from a fence line (3') . The trouble is sometimes people build structures that are not to regulation. I would get checking immediately. it depends on your deed restriction which are in your deed. It also depend on if this is a town house or a condominium or a house. At any rate, normally your structure cannot exceed the property lines and anything you have that crosses those line your neighbor has the right to tear down. So, hopefully your neighbor is wrong or you may lose those gutters.

You might want to go to city hall, and get the actual plans for your property lines. Our neighbour tried something similar. he wanted to put a new fence 18 inches onto our property, saying that our sidewalk was actually on his property.
