I lent my brother 40K USD that he needed in an emergency. That was almost 10 Years ago. He claims he will pay when he can but has yet to do so. Is the a year limit where now he won't owe me anymore. I am considering legal action but don't want to waste time and more money if it is too late.

bummer...lesson from this= when u lend money to family or friends u must be willing to not to collect. just the way it usually goes for most people, so next time if u need the money more then don't lend it out.

Do you have anything in writing? I would talk to a lawyer. You maybe entitled to interest as well.
