Fair? Well, that's subjective at best.
The company has policies and rules that you must abide by in order to work there. One of these rules would be "no drug use." If you read the rules, it likely doesn't say "no drug use, unelss you visit a country where it's legal." They're more concerned with the type of person who would take drugs being employed, and not with people who are simply breaking the law.
Just like a bank doesn't want people with bad credit, and a security company doesn't want someone who steals things, most companies do not want people who do drugs. These policies have little or nothing to do with the law. Even if drugs were suddenly legalized in the U.S., the chances of any significant amount of companies relaxing their "no drugs" rules are slim to none.

well that's an interesting question. that depends on the philosophy of the company. if they test you because they don't want people who use drugs at working at their company then yes it is fair. if they want to avoid hiring people who break the law buy buying and smoking drugs, then not really because it is tolerated in the Netherlands. i was studying there for 4 months but quit smoking about 3 weeks before i left just to make sure because i didn't want to chance it. if you truly feel discriminated against, then contact a lawyer. you did nothing illegal by smoking weed in the Netherlands and they shouldn't be able to discriminate against you for it...but if it doesn't matter then just find a new job

well, since you ARE applying for a job to a privately owned comapny who is enforcing laws that are on the books in the USA, then yes, it is fair if you do not get the job. legal or not in holland, it is still illegal in the US to possess or use marijuana or andy marijuana paraphenilia. so if you want to smoke out as they say, and want to have a job, then maybe you should find someone who doesnt do drug testing (very rare anymore) or move to a country where drugs are legal

They are trying to make society drug free, so they are using all kind of technique now a days, I think it is fair for you not to get the job, that is their policy, don't smoke the weed and work with my company

Sure its fair. They don't want a drug user and you are a drug user. They don't care if its legal there and not here. They don't want someone with that habit.
They may have a branch in Holland and might still give out drug test.

"fair" does not exist when ur looking for a job. you shouldnt have been smoking in the first place when u knew that there was going to be a drug test. FYI, now almost every job requires that people take drug tests.

Yes, it is fair. Illegal is illegal here. I do believe they should abolish the pot laws though. The system is archaic and in dire need of an overhaul. I quit 20 years ago but the worst drug I ever did was alcohol. When I smoked pot I was never: violent, argumentative, falling down high, nor arrested. I was all of the above and more on booze.

Although smoking marijuana is tolerated in the Netherlands, it is, in fact, illegal there. The Dutch authorities tolerate it in much the same way that American authorities tolerate underage drinking among college students. The bottom line is, you've still done something illegal, and something that impairs your judgment, and a company has the right not to hire you because of this.
