Or do they try to get away without paying royalties to the original artist? Obviously I know it depends on the sample, its length and how blatently it is used in the song, but I'm talking about in general. The reason I ask is because I am a hip hop producer, and sampling is just such a huge part of hip hop culture. When you clear a sample, you almost always have to pay a fee to the original artist, or share the profits—but if so many recording artists sample, how can they afford to pay these fees? (and I'm not talking about multi-million dollar rappers on big record labels—I'm referring to smaller, indie artists who sample (like myself.))

I am quite sure they have to pay a residual to use a sample..most music you hear now a days is copyrighted for protection against illegal use. Someone owns the the music and lyrics. It could be costly if you get caught, If you are hoping to get a bigger contract, why sample?
