Is it called rape if you do it with someone over 18 and your under 18 and like around 15. Why would it be rape if you invite the person over and want it i thought rape these days was like someone like a stranger captures you ties you up and you don't want it but they do it not when you actually invite them. i'm just curious it's not like i ever had sex or will because i'm too young now. Oh and this is not with the subject but i would just like to know whats the the legal age limit of being able to go to jail for kids and adults and which is tuffer and harder to go through lol tuffer i know i spelled that wrong.

It has to do with laws. Laws are often black and white. The situation you are describing is gray.

The thing is, young adults under 18-21 sometimes do not have fully developed brains -- seriously -- it's a physical thing.

So the law says they are not responsible and the person who is over 18 is the one responsible. So if a 15 year old is not responsible, then that person should not be put into a position to be taken advantage of. The idea being, is they do not understand that they ARE being taken advantage of.

It is commonly called statutory rape, but that is just a common name for it. The actual name by law varies by state. In Texas, this is called sexual assault and counts just like any other sexual assault where there is no consent.

The second half of your question cannot be answered without knowing which state you are in. Each state, or country, sets its own laws for when a person can consent to having sexual relations. In the US, you can generally accept 18 as the highest age, but there will be states with lower ages of consent. In Texas, the age is 17.

I was just re-reading the question and I am not sure exactly what you are asking. Are you asking what age a person goes to juvenile versus adult jail, and which is tougher? Again, this will vary by state. In Texas, a person must be 10 years old at a minimum to go to juvenile, and normally goes to a real jail at 17. A person under 17 can go to jail as an adult if the court certifies him as an adult after a hearing on the issue.

As another poster mentioned, its called statuatory rape. Although someone under 18 may be willing, in the eyes of the law, they are not an adult yet and therefor not in control of their actions/emotions.

The legal age limit varies depending on the state you live in. In some extreme cases, a judge may state that a 12 year old be charged as an adult although those are usually overturned.

As for which would be harder, you would have to ask someone who has gone through it. My gut reaction would be that actual jail would be tougher than juvenile hall.

different states have different legal ages of consent, that is the age at which a person must be before they can say yes to have sex. to answer more of your question there are two types of rape there is forcible rape, which is the rape you most commonly think of. then there is satutory rape, which is where a person has sex with another person who is unable legally to say yes, that would be someone who is under the age of consent OR someone who is drugged, or drunk. the law states that people under the age of consent or somehow impaired are unable to make a good sound judgement. you can do a search for legal age of consent on the internet and it'll give you a listing by state of the different ages and stipulations.

It is called statutory rape, it is held that someone below the magic age of 18 is not mentally ready to make the decision to have sexual relations by consent. Hell they would roll over if they found out I started at 12 with an 11 year old girl, she ask me. I am 60 now and she is one of my fondest memory's.

Its a law in place to protect younger people from getting themselves into situations that they are not mature enough to handle.

At the age of 15 i thought this was stupid and i was mature enough to handle it and i could have sex with older people if i wanted too.. now that im much older i realize what a bunch of crap that idea was, and the people who made these laws already understood that i was not capable of making that decision.

Having sex with a willing minor is called statutory rape. I dont know why its called rape but in most states it is against the law.
