with cruel and unusual public punishment...

I think this is very dependent on the crime. First and foremost, I think compassion should be a strong mix with the judgment laid down. I think we need more judges who are like Solomon---truly wise and analytical thinkers, who are capable of meting out smart punishments that fit the crimes, yet in accordance with the law. This could range from a slap on the hand, to a fine, to community service, to time in prison. And, if it's the latter, this is a good time to say that I believe in prison reform. There are some folks who should do time, and some who should do time for a long time (and probably never emerge, because they can't function properly in society), but there should not be a one-size-fits-all approach to incarceration. I don't think putting a person to death is a good idea---I'm against the death penalty. It doesn't really change anything-----see the stats and stories of families who thought it would. If someone murdered a family member of mine, I'm sure I would want to go after that person with my bare hands; however, would that be the optimum solution? Despite my passionate reaction, I think it would be better for that person to live his/her life out in a monitored situation because a) that person may have been mentally incapacitated when he/she committed the crime, and it would be wrong to kill someone who didn't understand his/her actions, or b) if a person was that calculating, then I think that person (by virtue of being another human being) should be given the opportunity to redeem him/herself and spend the rest of his/her life seeking forgiveness. Ultimately, if someone who murdered a family member of mine were able to make this leap after committing such an act, I would feel that that would be true justice----to illuminate and shepherd another human being towards self-realization.

frankly, I believe that the criminal should suffer the same fate and the victim that they victimized
