I have a client that called and made a reservation to travel to Europe. Three days after that called to pay for the reservation, but she wanted to send a check and the reservation was canceling that day. So I issued two tickets without having a payment. I didn't recieve her payment and she is not answering the phone. She doesn't have the tickets but that is not the point. If I am going to cancel these tickets I have to pay $125 per ticket. Is there any way that I can get her to pay for this??? THX

Just giving you an update.
After I called her every hour today, and contacted her friend that bought tickets from me as well, she ended up returning my calls. She said that the check returned to her and she is not sure way. She told me again that she will mail it out tomorrow. I have been in this business for almost seven yeras and haven't had this problem. Hoestly, I haven't done this for anyone. She seemed so innocent and needed those tickets but couldn't pay for them right the way. I do not care about the $250, but the thing is that I tried to help her and she has caused me so many headaches. I will sign on again on Saturday to let you know if I got the check or not. By the way, I do not take personal checks for clients outside of my area, only official checks. Learn from my mistakes. No matter how much they need help do not do anything that will hurt your wallet. Thx

Not if she didn't sign a contract. Sorry expensive lesson to learn but do not order till cash is in your hand.

She has made it apparent she is not going to pay for the tickets. You need to mitigate your damages, i.e cancel the tickets, and pay the $125 x 2. Then threaten her for the money you are out. You should probably send her a certified letter setting forth exactly how you have tried to contact her and that you relied on her representations that she was sending a check for payment of the tickets. Ask for the amount of money that you are out, give a specific date to pay you by, and tell her if she hasn't paid you by that date that you will pursue all your legal rights, including filing suit for the money. You should be able to do a small claims action yourself without an attorney. Just keep good records of all conversations, attempts to call, and correspondence. (Probably would not have been a good idea to take a check for the tickets anyway...what if it bounced.) Good Luck.

Sounds like you learned a valuable lesson. I dont know if there is any way to get her to pay. Do you have a contract of any sort? If you do, small claims court might be the way to go.
In the future, you need to take a credit card to do a pre-authorization for payment. then when you dont get your check, you can go to the card. If you do get the check, then the pre-auth drops off after 7-14 days or so.

and you got the tickets without a credit card payment?
most agentcies will not take check, and if they do they wait 3 weeks plus for them to clear
burn the 125 per ticket
and chalk it up as a lesson learned that you'll never order unless they pay with valid credit card or cash.

Needless to say, you should not have sent the tickets until her money cleared the bank, but you'll know next time ... however, at this point, it may well be appropriate to send a letter to request immediate payment or the account will be sent to collections (or referred to small claims court).

I would contact the district attorneys office and find out from them what your recourses are. I'm sure there is a legal way for you to recoup at least part of it if not all. You may have to go to small claims court. Good Luck!

Yes. You will probaby have to take her to small claims court to get your money. It is her responsibility to pay.
