As stated it depends on where you reside. In Florida you can get divorced in no time and remarried the same day as the divorce. That is if there are no children involved. If there is children involved then it can be a long process because there has to be child support issues, Dividing Property, visitation with the children, Attorney`s fees, the court will request a copy of what you make and your soon to be x makes. You have to attend a parenting class before the divorce and get a certificate saying you did so. And if this is contested in anyway by you or him it could drag out for months or a least a year or so. Is only simple if there is no kids or property to divide or children involved. Also if he cheated on her some states have adultry laws.

I am a Paralegal in Florida and can answer most of your questions but alot depends on your state. Most of all a simple uncontested divorce where neither party wishes to contest the divorce and have pre divided the marital assets and with no children is the easiest and quickest. So it pays to have it all worked out before court. Also you can remarry right after your divorce but all states have some kind of waiting period before the wedding so check your state or others. good luck and let me know if I can help

I'm in California. My ex and I filed amicably and without using an attorney. We filed the petition, response and all documents together. An uncontested divorce in California is effective 6 months from the date the documents are filed with the court (assuming that everything is in order). You're free to re-marry once the divorce is final (In California, the document actually shows that date).

It all depends on where she lives, all states have different laws. As soon as the papers go through the court, they can turn around and marry in front of the judge if they wanted.

all states are different. it can take 6 months to a year. if there are children invovled it can take longer. if both of you are ready and have decided on who gets what you can file in pro per. this way you don't need to pay a lawyer. you can get the paper work from the court house. as soon it is final you can remarry. i noticed an answer on the top. you can keep a second marriage. my first on lasted 5 years. full of abuse. my second one is goning on 18 years. good luck with your second.

All depends on your state laws. In maryland it takes a year after the papers are filed before the divorce is granted.

Varies from state to state also if they are doing their own divorce are there children & property involved. Some states allow for the divorce to be finalized the day you go to court if both parties agree. Expect in general, if things go smoothly to take up to a year.

In my state of Missouri, you can not marry until the divorce is final for 30 days. I filed for divorce in April and it was granted in August but that was with no fighting at all. We had kids but there was no arguing, he agreed that I got everything. If we had fought, it would have taken a lot longer.

Please tell her to examine any documents that has her name on it ---Examples --Titles to cars, deeds to houses, etc..... I went through a divorce 10 years ago and got BURNED because Nobody told me about certain stuff. If you are an authorized user on his credit card ---they can and WILL come after you for the debt if it is not paid by him ---even if it is in the divorce decree that he is to pay it. The same is true if you have any joint debt ---such as cars or a house. Just be careful and cover your butt when it comes to this stuff and MAKE him refinance EVERYTHING that the divorce decree says he is responsible for ---trust me, I learned the hard way!!!
