I just observed a scandalous scene inside a government public facility where a lady just stormed in & started yelling "who owns a Jack Russell terrier inside a car outside?!!!" it was 110 degrees that day but with windows rolled down & I later found out the dog has a bowl of water in it & the people who owns it were just doing a quick chore in that govt facility, b4 going to the beach. The lady added hysterically & shouted: "did u know that w/in (?) mins they can die? Dog killer! (or murderer!) I will take your dog if ur not going to leave now & take her home! I will call Humane Society!" She kept going on & on until 1 of the owner said: "Mind your own business or I will sue you for libel & slander. We just arrived and my wife will go back to the car after she helps me with (whatever they were doing there, i did not hear)". When I left the place, she was still going on & the man's # was called and he was just quiet while the wife went to the car/dog. What is ur opinion on this?

Well, the woman definitely over reacted and should have gotten her facts straight instead of flying off the handle, but I give her points for speaking up on behalf of a helpless animal at all. Even though this particular one was not being abused. However, she could have handled it in a more mature manner and not like a child having a temper tantrum. Or she could have simply contacted the police to look into it. Beyond that it was none of her business.

Of course the man is going to react defensively to a full frontal attack like that. I would too, even if it was just talk in the heat of the moment.

The average temperature inside of a locked car can reach as much as 40ºF higher than the average temperature outside, which means that even in a mild 70ºF weather outside, the inside of the car reaches a whopping 110ºF. Neither animals or children should be left inside, most especially if you live in a Southern state where (most especially Texas and Florida, where the average yearly temperature is 70ºF.

In other words, the woman WASN'T overreacting. There are countless cases of infant deaths every year because caretakers were going inside "for a few minutes". About a year or two ago, a woman in Texas forgot to leave her 6 month old infant at daycare and inadvertently left her in the car for her entire work shift. Needless to say the infant was dead by the time she got into the car ready to go home. And cases like this one have been a dime a dozen in Texas alone.

So those of you who think this woman is overreacting and needs to mind her own business REALLY have a lot to learn before they judge anyone.

first cops are not the best source of legal advice in general and esp in civil litigation. As stated above the police can not stop you from filing a law suit

That said from what I have read the poor people who where called on the carpet for leaving a dog in dead summer in a car with a little water, Since dogs do not sweat but release heat by panting the water would have done little to help the dog , the car just gets to hot in relation to how fast the dog can cool it's body even with windows down little breeze, Ever look around and see it's only people that go out in dead of summer at high noon 110 degrees? all other animals are somewhere cool not us

. want to make a libel suit? yeh first the statements where true, second you really going to find a jury to take pity on them?

Well, even with the windows open a parked car in the sun can get enough heat in it to kill a dog or any pet. The water would warm up too, but was a nice touch, basically the person tried to be kind to the dog but just didn't realize the heat in that parked car can still hurt the animal. And no the dog owner cannot sue the person yelling because it was in good faith they were trying to prevent animal abuse.

PS and no it isn't the cops business to tell a person to file or not to file a lawsuit, they could suggest the person wouldn't win but it's not their choice, the person can file if they wanted to but in all liklihood, they would not stand a chance.

To answer your main question, a police officer cannot order you to stop a lawsuit against another person.

Regarding the rest of your post, I'll say this: Libel and slander laws only come into effect if 1) The things said/printed are false and 2) The things said/printed result in the loss of, or inability to gain, employment.

Regarding the woman that was reaming the man, good for her.

Regarding the man who told her to mind her own business and shut her trap, good for him.

The better way would be for the lady to call animal control, but because she shouted it in a public place ... she can be open to some kind of legal suit. However, the rewards of actually going through with such a suit would not outweigh the cost and efforts of doing so. I think the cops handled it right.

No the police officials do not Even recognize The guidelines they're PAID to implement,Thats Why we've legal professionals(criminal Aides legal professionals Too Lazy To Do $hit)And Judges,you are able to Sue Any body For Any difficulty Its as a lot as The Judicial Then(decide Or Jury)Ain't u . s . a . of america great

it blows my mind that people leave anything alive in an unairconditioned car in the summer. last year i saw a baby unattended in a parked car. i tend to freak out too because it is dangerous.

the lady may have been overreacting; but i don't even see a lawsuit in there. you have no right not to be yelled at by nuts.

She sounds like she's postal. However, even though she was way out of line, she has a point. You really shouldn't leave an animal in a hot car. What if their quick errand took longer than they thought?
