my car was at the mechanic shop and a tow truck came to drop off a car and while he was backing up he slammed right into my car pushing in the whole drivers side. i have a 318Ti 2 door BMW coupe so they're pretty small and well you know a tow trucks width is big and steel at that so it did some pretty good damage. the tow truck guy is saying he will pay damages but hes giving me a hard time about sending it to the BMW collision center. i gave him a day to call me back and still no word just yet. so my question is who should accept responsibility. the tow truck driver or the mechanic shop. if the tow truck driver tries to keep avoiding to give me his insurance info can i go after the mechanic shop as a form of back up cause they were the ones that had possession of my car. They had a different tow truck come get the vehicle from my house and they had it on their lot for 2 days prior to the incident. Im stuck whats my next move?

the tow truck guy said he does have insurance but he carries his own cuz hes an independant contractor so he wants to settle without insurance. he want it to be fixed by his friend. i said the bmw center said the wheel alignment is probably off and the train mounting points probably off as well and maybe worse a cracked frame. the mechanic shop is a small shop and it was only there to replace the cooling tube hose which the OEM part was $60 to begin with so wasnt a big thing. Worse part is the mechanic shop is owned by my fiance's boss. he owns a road side service and a mechanic shop-2 differ companies. and i guess they do alot of bussiness with this guy and the guy called the owner and said i cant afford the dealers price get them to take the car to my friend, it will be good and quicker. the boss called my fiance in and told him go with the guys friend. what kind of SHNIT is that huh. my fiance said its not my call the car is hers and in her name. again IM STUCK.

you don't need to go court unless you want to drag this out forever the shop has no liabillity at all call the tow truck company and get there insurance you can bring it anywhere you want to get it fixed thats the law get an estimate give the bill to the tow driver if he wont pay go to his insurance if he wont give insurance info call police as he is breaking the law and will loose his license you should be able to settle in 1 week

The tow truck company is at fault. Their insurance will pay for it. You can find out who there insurance company is by calling and asking. Then you can call the insurance company. Or call D.O.T. and ask them for help. The Tow Truck company is responsible and will pay.

The one thing I can tell you with certainty, THE AUTO REPAIR FACILITY IS NOT RESPONSIBLE AT ALL.

So go after the tow truck company and get your money for repair. It is not unacceptable for them to ask you to get three bids for repair and then give you the average of the three for your body repair. They are not out of line asking you to take it somewhere for an estimate.

You are not entitled to NEW body parts... you are entitled to parts that are the same LIKE, KIND & QUALITY. So therefore if your bimmer is a 2000 with 60,000 miles then the replacement parts need to be used, and off a simillar car. I hope all that makes sense.

Hope I have been helpful here, I am sure you will have no problem getting the Tow Truck Company to pay for the damages.

Go to court and sue the tow truck driver, the towing company and the repair shop. Let the judge decide who shoule pay but you take the car to the repair shop of your choice, not theirs.

Hi,if your car was on the mechanics lot,for any amount of time,and you told the mechanic what the problem with your Beamer was,and left it in his "care",then he is responsible for any damages incurred on his property.They have insurance for vandalism theft and dents and scratches incurred on the lot.Sue the mechanic if he refuses to pay compensation.Also you do not have to go to his preferance of body shop,that is your perogitive.Good luck.

i would go after the repair shop since the car was under their control ,on their lot. they are responsible for keeping your car safe , that why you pay so much for their services.
let them go after the towing service, if they want to ,their insurance will just pay it anyway.......................

Go for the mechanic shop, if its a big name shop they shouldn't have a problem taking care of it. nevermind... I like that guys answer better, sue their asses off.

all you need to do is call your insurance company they will handle it from thier
