They were seperated over 7 years when we met. It was an ugly situation and my husband tried to serve her divorce papers but she refused to sign them. We paid for an uncontested divorce and when we went to court for something else the judge said our marriage was over turned by her. Is that legal?

Yes, if a judgment was not entered for his previous marriage, then his current marriage is voided. However, there is a way to remedy the situation. He will need to get a Nunc Pro Tunc Order entered. A Nunc Pro Tunc Order, if granted by the court, would allow for you a retroactive date to be set on the Judgment.

The question is why wont she give him the divorce?
Shes hangin on like a little critter. Some people just love company when they are in misery.
If I were you I would get an attorney and put an end to her ***

Yep, if he didn't complete the process for the uncontested divorce then his marriage to you isn't valid because he was not legally divorced yet.

Find out. See a lawyer. If the marriage was overturned there should be court papers filed and you both should of been notified.
