Hire a good divorce lawyer to help you decide. There are many things to consider such as your length of marriage, do you have dependants, property, and/or debt. With a divorce, everything will be divided equally between the two of you, including debt, unless a pre-nuptial agreement was signed. With a legal separation, you will still need to file as married on your taxes.
If you are determined to divorce, then file for a divorce. If you file for a legal separation, you will be paying for the court costs. You will pay court costs again when you file for a divorce. Bear in mind that both are relatively expensive processes. If you feel there is a possibility that the two of you could resolve your differences then file for a legal separation.

If you file for separation and do not make it offical six months after, you have to go through the process all over again and that means more money. My advice is if you are pretty sure you are done, just file for divorce. You'll save about $500 doing it that way.

I don't think marriage vows say anything about seperation or divorce. Stay married. Get help. Read books on marriage. Call Dr. Laura. You will forever regret being a divorced person. The ONLY three reasons for divorce are 1) abuse 2) your spouse has a mental disability you didn't know about previous to your marriage 3) your spouse participates in illegal drug use or illegal activities

If your trust him with your credit, children and property then don;t waste time with legal separation.
A legal separation just sets financial responsabilities and veistation issues while the divorce is being processed, and have no legal relevance other than being a contract in between the both of you.
Good luck

If there is a chance of staying together, just seperate. But if you are sure that things will not work out between you two, then file divorce. Because your asking this question, I'm assuming that you dont want a divorce. I advise that you just seperate to make sure its what YOU want, then file divorce if your feelings haven't changed.

It relies upon. in the adventure that your state has a criteria that's necessary be legally separated, or purely separated usually, in the previous you could divorce then no you could not stay at the same time. some states obviously say that you won't be able to be cohabitating, in case you do then you is purely no longer able to report for divorce. in the adventure that your state does no longer have this criteria, then i wager you ought to. in spite of the actual incontrovertible truth that, i'm questioning why you ought to favor to. Why no longer purely stay married?
