I think there's a lot to be said for this point of view. It is sad that the reactionary new right in america and UK have over simplified the idea and made a distiction between the rights of "the innocent" over those viewed as presumably sub human.
Human rights are universal and not the preserve of one race, gender, religion , country, political ideology or the "law abiding"

It's definitely an indicator of how civilized it is. But perhaps even more importantly, it is a tell of the relationship between the people and the government. In the USA you see an obvious effort to control and subordinate through the process of "criminal justice", and to create more and more products of that system to achieve that end. When the crime of what's happening at Guantanamo is included, we see clearly the posture and true intentions of the gov't. But only to the extent that society is aware and allows this behavior, can it be related to it's level of civilization. Governments frequently do not reflect the sentiments or intentions of the people and it's important to keep in mind that it's government, or authority, that handles the criminal/penal aspects.

No. Still we don't have perfect civilised society because if we have there will be no criminals.
Than the treats of criminals depens of the people above them and nobody is perfect. Then you have different criminals act and some of them deserve drastic measure - masacr, raping children, extremly violence acts, with that kind of brein what is the measure for CIVILISED?
