I have the company name and truck number can I call them and ask them to replace my window??? Legally do they have to pay for it???

in some cases, they dont, but if that were to have caused an accident, that would be different. if a truck was involved in an accident with you, and if the truck was at fault, then you would get compensated.

do not make an insurance claim because with the amount of the deductable, usually $250-$500, the window is cheaper and your insurance rate would go up.

Unfortunately you are stuck w/ the bill- The truck company will not pay for it because it was not the drivers fault, they will tell you that u should have kept a safe distance from the truck, even though you were not tailgating u should have stayed far away and they may question wethere the rock actually came from that truck-- Cracked winshields due to flying rocks in highways happen all the time-- You could go w/ the insurance company but your deductible is probably $500 and it will not make sense to make a claim...
I just had my windshield replaced yesterday for the same problem, (happened 3 weeks ago) i had to pay $225, it sucks but now i know to stay FAR AWAY from large trucks! .... And even that wont guarantee me safety!

You will not get a dime from the trucking company. This happens very often. Legally, you can't prove the rock actually came off the truck. There is usually a sign on the back of the truck - "Not Responsible For Objects Coming From The Road" Can't hurt to call them anyway, just don't expect anything.

Call the trucking company and tell them what happened. You probably should have called the state police when it happened though. If you have no witness or police report, how does the trucking company know they caused it instead of you noticing a truck hauling rock and getting the phone and truck numbers. They have to look out for fraud also so don't be surprised if they don't do anything. Your insurance company will pay for it minus the deductable, which is probably more than a new windshield.

In most states, trucks carrying loose loads are supposed to cover them to keep things from falling out. Most gravel trucks don't comply with this law, because the drivers are in too big a hurry to deliver their load and go back for another one...

If the truck was in violation of the state law, then you should call the police and report an accident. Once you have an accident report, you can go to the trucking company and try to get them to pay for the damage, or just let your insurance company do it for you.

I drive a truck for a living and in Ohio it's like this...if the rock fell off the truck and hit your car then the trucking company is liable. However if the rock fell from the truck and hit the roadway first and then hit your windshield then you are SOL.

Call the company first, you will probably get the run around. Call your insurance company and file a comprehensive claim. You will have to pay the deductible if they replace the full windshield, however, If it can be repaired, alot of insurance companies will waive the deductible. Your rates should not go up...Good Luck!

Check with your Insurance Company. In Florida insurance companys have to pay to fix windsheilds. No deductable. They pay 100%. Also in Fl. against the law to drive with it cracked.

Well, I can fully understand how you feel. I had the same experience years ago. I managed to get the driver to stop, but he refused to let me have his personal particulars. I did not take any photos at all. He even got his boss to collaborated with him and told the traffic police that he was transporting sand with his lorry on the day of accident. In the end, I was the loser.
